Terms of Use

These terms are between you and Phixx Creative Pty Ltd (ABN 35 448 240 623, ACN 665 754 941) ("Phixx", "we", "us"), operator of Kith (kith.life). By creating an account, accepting a household invite, or using Kith, you agree to these Terms and our Privacy Policy.

1. What Kith is — and isn't

Kith is budgeting and money-organising software for households; you manually enter your own figures. Kith is not a bank, deposit-taker (ADI) or financial product, and does not hold, move or transfer money. Kith does not connect to your bank accounts. Kith provides general information and tools only — not financial, investment, tax, accounting or legal advice — and nothing in Kith is a recommendation to acquire or dispose of any financial product. For financial decisions, consult an appropriately licensed professional.

2. Eligibility and accounts

You must be 18 or over. Keep your login secure; you're responsible for activity under your account and must tell us at support@phixx.com of any unauthorised use. You're responsible for what you enter.

3. Households and invited members

Kith shares budgeting information among household members. If you invite someone, you confirm you're allowed to share the relevant information. Adults may see shared household data and are responsible for any children's records they create.

4. Subscriptions, billing and cancellation

Paid plans are billed through our processor on the cycle shown at checkout. Current prices and the billing cycle are shown before you subscribe; paid plans renew automatically each cycle unless you cancel. You can cancel anytime in settings (effective at the end of the current period). Except where the law (including the Australian Consumer Law) requires otherwise, payments are non-refundable. Your statutory rights are not affected.

5. Acceptable use

Don't: use Kith unlawfully or with others' data without authority; access accounts or data that aren't yours; reverse engineer, scrape, overload or interfere with Kith; resell or commercially exploit Kith without our consent; or upload malicious code. We may suspend access to protect Kith or its users.

6. Our intellectual property

Kith — its software, design, content and the "Kith" and "Phixx" names and logos — is owned by Phixx or our licensors and protected by the Copyright Act 1968 (Cth) and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use Kith for its intended purpose while these Terms apply. © 2026 Phixx Creative Pty Ltd. All rights reserved.

7. Your content

You keep ownership of the information you enter ("Your Content"). You grant us a licence to host, store, process and display it only as needed to provide Kith to you and your household, and as described in our Privacy Policy. You're responsible for Your Content and for keeping your own backups.

8. Availability

We work to keep Kith available and reliable but don't guarantee uninterrupted or error-free service. We may modify or update features, with reasonable notice of significant changes where we can.

9. Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded (the "Non-Excludable Rights").

10. Limitation of liability

Subject to clause 9 and only to the extent permitted by law: we're not liable for indirect, special or consequential loss, or loss of data, profits or savings, arising from your use of (or inability to use) Kith. Because Kith relies on figures you enter manually, we're not responsible for outcomes from inaccurate or incomplete information you provide, or for financial decisions you make using Kith. Our total liability for any claim is limited to the amount you paid us for Kith in the 12 months before the claim. Nothing in this clause limits the Non-Excludable Rights or any liability that cannot be limited by law.

11. Suspension and termination

You may close your account anytime. We may suspend or terminate access if you breach these Terms, to protect Kith or others, or if we stop offering the service (with reasonable notice where practicable). On termination your licence ends; you can request export or deletion of Your Content, subject to records we must keep by law.

12. Changes to these Terms

We'll post updates with a new effective date and, for material changes, notify you (for example, by email or an in-app notice). Your continued use of Kith after the changes take effect means you accept them. We record the version you first agreed to and always show the current version in the app. If you don't agree to a change, you can stop using Kith and close your account. This doesn't limit your Non-Excludable Rights.

13. Governing law

These Terms are governed by the laws of Western Australia, Australia; you and we submit to the non-exclusive jurisdiction of its courts.

14. General

If any term is unenforceable, the rest continue. Non-enforcement isn't a waiver. These Terms and the Privacy Policy are the whole agreement about Kith.
